Terms of Service

Welcome to Kasamusa (“Kasamusa,” “we,” “us,” or “our”). Kasamusa is an AI-powered conversational entertainment platform that lets you chat with fictional AI characters for fun, roleplay and companionship. These Terms of Service (“Terms”) are a binding legal agreement between you (“you” or “User”) and Kasamusa governing your access to and use of our website, apps, APIs and related services (collectively, the “Service”).

By creating an account, clicking “I agree,” or otherwise using the Service, you confirm that you have read, understood and accepted these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility & Age Requirement

Kasamusa is intended only for adults aged 18 or older. By using the Service you represent and warrant that (a) you are at least 18 years of age, (b) you have the legal capacity to enter into a binding contract, and (c) you are not barred from using the Service under the laws of India or any other applicable jurisdiction. We may request age verification at any time and may suspend or terminate accounts that we reasonably believe belong to minors.

2. Nature of the Service — Entertainment Only

Kasamusa provides fictional, AI-generated conversations for entertainment purposes. The characters are not real people. Every message, image or voice output produced by the AI is generated automatically by machine-learning models and may contain inaccuracies, fabricated, outdated, misleading or offensive content. AI outputs do not represent the views of Kasamusa, its team, investors or partners.

Kasamusa does not provide medical, psychological, legal, financial, tax, investment, safety, or any other professional advice. Nothing generated by the Service should be relied upon as such. Always consult a qualified professional and independently verify any important information before acting on it.

3. Your Account

• You must provide accurate information when registering and keep it up to date.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• Notify us immediately of any unauthorized use or security breach.
• One person per account. You may not sell, transfer, or share your account.

4. Acceptable Use

You agree to use the Service only for lawful, ethical purposes. You must not, and must not attempt to:

• use the Service in violation of any applicable law, regulation or third-party right;
• engage in or solicit content that sexualizes or endangers minors, promotes terrorism, human trafficking, self-harm, suicide, illegal drugs, weapons manufacture, or non-consensual sexual acts;
• harass, threaten, defame, dox, impersonate or defraud any person;
• use the Service to generate or distribute malware, spam, phishing, scams, or misinformation;
• attempt to reverse-engineer, decompile, scrape at scale, or bypass rate limits, safety filters or paywalls;
• use the Service to train or fine-tune competing AI models, or to resell AI outputs as a stand-alone product;
• upload content you do not have the right to use, or content that infringes intellectual-property or privacy rights.

Kasamusa never encourages illegal activity. Any illegal, abusive, fraudulent, harmful or suspicious behaviour is strictly prohibited and may be reported to law-enforcement authorities.

5. User Responsibility

You are solely responsible for how you use the Service and for any decisions, actions, communications, relationships or transactions you undertake based on AI-generated content. You accept that outputs are fictional and may be wrong, and you agree to independently verify anything important before relying on it.

6. Payments & One-Time Purchases

• Prices are shown in Indian Rupees (₹) and are inclusive of applicable taxes unless stated otherwise. Payments are processed by third-party providers such as Razorpay, subject to their own terms.
• All purchases on Kasamusa are one-time payments. There are no recurring subscriptions and nothing auto-renews.
• Messages, image generations, voice minutes and other digital entitlements are licensed, not sold, have no cash value and cannot be transferred.

7. Refund Policy

Because digital goods are delivered instantly and consumed on demand, all purchases of messages, images, voice minutes and other digital items are final and non-refundable once delivered, except (a) where a refund is required by applicable mandatory law (for example, statutory consumer-protection rights that cannot be waived), or (b) where we, at our sole discretion, decide to issue a goodwill refund. Failed or duplicate charges caused by a technical error on our side will be refunded on request.

8. Intellectual Property

The Service, including the Kasamusa name, logo, characters, artwork, UI, code and underlying models, is owned by Kasamusa or its licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial enjoyment.

You retain ownership of the prompts you write. By submitting them, you grant Kasamusa a worldwide, royalty-free licence to host, process and display them as necessary to operate, secure and improve the Service. AI outputs generated for you may be used for your personal, non-commercial purposes; you must not present them as human-authored or as factual statements by Kasamusa.

9. Third-Party Services

The Service integrates third-party providers (for example xAI Grok for chat and image generation, Google Gemini for voice features, Supabase for storage and auth, and Razorpay for payments). We are not responsible for the acts, omissions, content, availability or policies of any third party.

10. Suspension & Termination

We may suspend, restrict or terminate your account or access to the Service at any time, with or without notice, if we reasonably believe that you have violated these Terms, created legal or safety risk for Kasamusa or other users, or engaged in fraudulent or abusive behaviour. Upon termination, your right to use the Service ceases immediately; unused messages, images, voice minutes and other pre-paid entitlements may be forfeited to the extent permitted by law.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, UNINTERRUPTED OPERATION OR FREEDOM FROM ERRORS OR HARMFUL COMPONENTS. WE DO NOT WARRANT THAT AI OUTPUTS ARE ACCURATE, COMPLETE, CURRENT, SUITABLE FOR ANY PURPOSE, OR FREE OF OFFENSIVE MATERIAL.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KASAMUSA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, RELATIONSHIPS, REPUTATION, OPPORTUNITY OR EMOTIONAL DISTRESS, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR AI OUTPUTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO KASAMUSA IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) INR 1,000.

Without limiting the above, Kasamusa is not responsible for any decisions you make, actions you take, real-world relationships you form or end, financial losses you suffer, or emotional impact you experience as a result of AI-generated conversations. You use the Service at your own risk.

13. Indemnification

You agree to defend, indemnify and hold harmless Kasamusa and its affiliates, officers, directors, employees and agents from and against any and all claims, damages, obligations, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of or relating to: (a) your use or misuse of the Service; (b) your breach of these Terms; (c) your violation of any law or third-party right; or (d) any content you submit or actions you take based on AI outputs.

14. Changes to the Service or Terms

We may modify the Service or these Terms at any time. Material changes will be notified through the Service or by email. Continued use after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law & Disputes

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Subject to any non-waivable consumer rights you may have, the courts located in Hyderabad, Telangana shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.

16. Miscellaneous

These Terms, together with the Privacy Policy and any additional policies referenced here, constitute the entire agreement between you and Kasamusa. If any provision is held unenforceable, the remaining provisions will remain in full force. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms; we may assign them to any affiliate or successor.
